Terms of Service

    Chapter 1: General Provisions

    Article 1 (Purpose)

    These Terms of Service set forth the conditions for using the tour sales service (hereinafter referred to as "the Service") provided by NeighborsFlavorsTours (hereinafter referred to as "the Company"). The Service connects the attractive areas of Awaji Island and Kansai, offering unique food culture and natural/cultural experiences specific to these regions.

    Article 2 (Definitions)

    1. "Tour" refers to travel, exchange, and experience programs conducted by guides certified by Shimatoworks Inc., the operator.
    2. "User" refers to a person who books and participates in experience programs through the Service.

    Article 3 (Service Content)

    1. The Company provides a platform for electronically mediating tours to users.
    2. The planning, implementation, and management of experience programs are all conducted under the responsibility of Shimatoworks Inc.

    Chapter 2: Service Usage

    Article 4 (Regarding Usage)

    1. Prospective users of the Service can apply for tours through NeighborsFlavorsTours.
    2. The Company may refuse registration if any of the following applies:
      1. When false information is provided
      2. When the person has previously violated these terms
      3. When the Company otherwise deems it inappropriate
    3. Users must be 18 years of age or older. For those under 18, consent from a legal guardian is required.

    Chapter 3: Responsibilities and Disclaimers

    Article 5 (Tour Operator Responsibilities)

    1. Tour operators are responsible for the following regarding the experience programs they provide:
      1. Safety management
      2. Accurate information provision
      3. Contract fulfillment with users
      4. Response to accidents
    2. Tour operators must comply with the Travel Agency Act and other relevant laws and regulations.

    Article 6 (Company Disclaimer)

    1. The Company bears no responsibility for accidents or damages during experience programs when users do not follow the instructions of tour operators.
    2. The Company does not get involved in any disputes between participating users.

    Article 7 (Compensation for Damages)

    1. If a user or tour operator causes damage to a third party in relation to the use of the Service, they shall resolve it at their own responsibility and expense.
    2. The Company's liability for damages is limited to 30,000 yen as the maximum amount permitted by law, and only to the extent of direct and actual damages suffered. However, this limitation does not apply in cases of the Company's intentional misconduct or gross negligence.

    Chapter 4: Personal Information Protection

    Article 8 (Handling of Personal Information)

    1. The Company appropriately manages personal information obtained through the Service in accordance with the separately established "Privacy Policy."
    2. The Company may use personal information for the following purposes:
      1. Service provision and operation
      2. Coordination with regional contractors related to tours from tour operators
      3. Analysis for service improvement
      4. Contact and information provision to customers

    Chapter 5: Miscellaneous

    Article 9 (Changes to Terms)

    1. The Company may change these terms as necessary.
    2. When changing the terms, the Company will notify users by the Company's prescribed method as necessary.

    Article 10 (Governing Law and Jurisdiction)

    These terms are governed by Japanese law, and any disputes regarding the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company's location as the court of first instance.

    Supplementary Provisions

    These Terms of Service shall come into effect from January 1, 2025.
